These Publication Terms of Service govern your access to and use of the JS Design Works website, blog, articles, newsletters, reader accounts, subscriptions, contributions, surveys, downloads, and related publication services.
The publication is operated by JS Design Works, LLC, referred to in these terms as “JS Design Works,” “we,” “us,” or “our.” Our website address is: https://designworks.app
By accessing the publication, registering as a reader, subscribing to a newsletter, purchasing a subscription, making a contribution, or otherwise using our publication services, you agree to these terms. If you do not agree, you should not use the publication or its reader services.
The JS Design Works publication provides educational and informational content related to website design, website development, WordPress, Elementor, search engine optimization, digital marketing, website performance, accessibility, user experience, artificial intelligence, online business strategy, and related digital topics.
The publication is intended to educate readers, share professional observations, build an informed audience, and support the professional authority of JS Design Works.
Publication content is provided for general educational and informational purposes. It is not legal, financial, accounting, tax, medical, cybersecurity, or other regulated professional advice.
You should consult an appropriately qualified professional before making decisions that could materially affect your business, finances, legal rights, security, technology, or operations.
Web platforms, plugins, software, search engines, algorithms, technical standards, and laws change over time. An article may no longer reflect the latest version of a platform, service, or requirement after its publication date.
You are responsible for determining whether any recommendation, code sample, configuration, plugin, service, or strategy is appropriate for your website, business, hosting environment, and technical requirements.
JS Design Works uses or may use Google Reader Revenue Manager to provide reader registration, newsletter signup, surveys, subscriptions, voluntary contributions, metered content access, and other publication engagement features.
When you use a Google-powered publication feature, you may interact directly with Google services such as Google Accounts, Sign in with Google, Google Payments, or Publisher Center technologies.
Your use of Google services is also governed by Google’s applicable terms and privacy notices. Google’s Terms of Service are available at https://policies.google.com/terms and Google’s Privacy Policy is available at https://policies.google.com/privacy.
Google is responsible for its own platforms, accounts, payment systems, security controls, and data-processing practices. JS Design Works is not responsible for an interruption, restriction, payment failure, account decision, or technical error caused by Google or another third-party service provider.
You must be legally capable of entering into a binding agreement to create a reader account, purchase a subscription, or make a contribution.
If you use the publication on behalf of a company or organization, you represent that you have the authority to accept these terms on its behalf.
The publication is not directed toward children under 13 years of age.
Certain articles, resources, or publication features may require you to provide an email address, register as a reader, or sign in using a Google Account.
You agree to provide accurate and current information when registering. You are responsible for maintaining the security of your Google Account, email account, devices, and other credentials used to access the publication.
You may not create an account using another person’s identity without permission, share paid access in a manner that circumvents access restrictions, use automated systems to create accounts, or attempt to bypass registration requirements, metering systems, paywalls, or content controls.
We may restrict or terminate publication access when we reasonably believe that an account is being misused, these terms have been violated, or access presents a security, legal, or operational risk.
When you subscribe to a JS Design Works newsletter or request publication updates, you authorize us to send the communications described at the time of signup.
Communications may include newly published articles, educational resources, publication announcements, website and marketing guidance, service information, and promotional messages from JS Design Works.
You may unsubscribe from marketing emails by using the unsubscribe link contained in the message. Unsubscribing from marketing emails may not prevent administrative or transactional messages concerning an active account, payment, subscription, contribution, security issue, or requested service.
We may invite readers to complete surveys or provide feedback about their interests, experience, professional role, business needs, website needs, or publication preferences.
Unless expressly stated otherwise, participation in a survey is voluntary. Certain articles or resources may require completion of a disclosed survey before access is provided.
Survey responses may be used to improve publication content, understand reader interests, develop articles and resources, personalize reader experiences, evaluate publication performance, and support audience-development or advertising strategies.
Do not submit confidential, proprietary, regulated, or highly sensitive personal information through a publication survey.
JS Design Works may offer paid subscriptions that provide access to premium articles, newsletters, downloads, templates, resources, or other subscriber benefits.
The price, billing interval, trial period, included benefits, renewal terms, and other material conditions will be displayed before purchase.
By purchasing a recurring subscription, you authorize the applicable payment provider to charge your selected payment method at the disclosed billing interval until the subscription is canceled.
Subscription access is personal to the subscribing reader unless otherwise stated. Subscriber-only content and downloads may not be resold, publicly redistributed, shared through account credentials, or used to create a competing content library.
Subscriber benefits may change as the publication develops. When reasonably required, we will provide notice of material changes affecting an active paid plan.
JS Design Works may allow readers to make voluntary one-time or recurring contributions in support of the publication.
A contribution does not purchase ownership in JS Design Works, create an investment interest, establish an employment or partnership relationship, grant editorial control, or require JS Design Works to publish a particular article or topic.
JS Design Works is not represented as a tax-exempt charitable organization. Contributions should not be treated as tax-deductible charitable donations unless JS Design Works provides written documentation expressly stating otherwise.
Publication payments may be processed through Google Payments or another payment service provider. Your use of Google Payments is governed by Google’s applicable payment terms and the Google Payments Privacy Notice available at https://payments.google.com/payments/apis-secure/get_legal_document?ldo=0&ldt=privacynotice.
JS Design Works may receive transaction and membership information made available through Reader Revenue Manager or the applicable payment platform. This may include your name, email address, order identifier, plan, membership status, transaction amount, billing frequency, purchase date, renewal date, cancellation status, and refund status.
Payment card numbers and other payment credentials may be collected and processed directly by Google or another payment provider. JS Design Works does not require you to submit your full payment card number through a standard publication contact form.
You agree to provide accurate billing information and authorize the charges disclosed during checkout. You are responsible for applicable taxes, bank fees, currency conversion charges, and other costs imposed by your financial institution or applicable law.
Recurring subscriptions and recurring contributions continue until canceled. Unless otherwise stated during checkout, a recurring plan renews at the end of each billing period and the payment provider may charge the payment method associated with your account.
Canceling a recurring plan generally prevents future renewal charges. Access or membership status may continue through the end of an already-paid billing period.
You may cancel a recurring subscription or contribution through the membership, payment, or account controls provided by Google or by contacting JS Design Works.
A cancellation does not automatically provide a refund for a billing period that has already begun. If you experience difficulty canceling, contact us using the information at the end of these terms.
Except where required by law or expressly stated during checkout, payments are nonrefundable after subscription access, membership benefits, or digital content have been provided.
JS Design Works may review refund requests involving duplicate charges, unauthorized transactions, payment errors, failure to receive purchased access, or other exceptional circumstances.
Approved refunds will normally be returned through the original payment method or payment provider. Processing times may depend on Google, the payment provider, the reader’s bank, or systems outside the direct control of JS Design Works.
A subscription may include a trial period, introductory price, discount, or promotional benefit. The applicable conditions will be displayed when you enroll.
Unless canceled before the disclosed trial or promotional period ends, the plan may convert to a paid recurring subscription at the price displayed during enrollment.
Some publication content may be available without registration. Other content may require reader registration, newsletter signup, completion of a survey, a paid subscription, a voluntary contribution, or another disclosed reader action.
We may change which articles or resources are open, registered, metered, premium, or otherwise restricted.
Purchasing or receiving access does not transfer ownership of publication content. It provides a limited, revocable right to view and use the content according to these terms.
Unless otherwise stated, the publication and its articles, tutorials, graphics, images, videos, templates, downloads, code examples, research, branding, logos, layouts, and subscriber resources are owned by or licensed to JS Design Works.
You may view publication content for personal or internal business purposes.
Without prior written permission, you may not republish a complete article, sell or sublicense publication content, remove attribution or copyright notices, present our content as your own, scrape substantial portions of the publication, redistribute subscriber-only resources, or use our content to create a competing publication or content library.
You may quote limited portions of an article for commentary, criticism, or reference when permitted by law and when appropriate attribution and a link to the original article are provided.
The publication may contain source code, configuration instructions, plugin recommendations, security settings, or other technical material.
Before applying technical material, you should create a current backup, test the change in a staging environment, review compatibility with your software and hosting environment, and consult a qualified developer when necessary.
You assume responsibility for changes made to your website, application, server, account, database, or technology environment.
The publication may discuss or link to third-party products, plugins, software platforms, websites, hosting companies, artificial intelligence tools, analytics services, or other resources.
A reference or link does not necessarily constitute an endorsement. Third-party services are controlled by their respective providers and may have separate terms, privacy policies, pricing, data practices, security practices, availability, and refund policies.
JS Design Works is not responsible for third-party content, products, services, transactions, representations, availability, or data practices.
The publication may include affiliate links, sponsorships, advertisements, referral relationships, or discussions of products and services offered by JS Design Works.
Material commercial relationships will be disclosed when required. JS Design Works may receive compensation when a reader purchases or signs up through certain links.
Editorial opinions remain those of JS Design Works or the identified author unless otherwise stated.
You may not use the publication or its reader services to violate applicable law, infringe intellectual property rights, distribute malicious code, gain unauthorized access, interfere with website availability, harvest reader information, abuse payment systems, send spam, impersonate another person, circumvent content controls, or test security vulnerabilities without prior written authorization.
If the publication permits comments, survey responses, feedback, or other submissions, you retain ownership of your original content.
You grant JS Design Works a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, moderate, and use the submission as reasonably necessary to operate, evaluate, improve, or promote the publication.
You represent that you have the right to submit the content and that the content does not violate another person’s rights. We may moderate, refuse, restrict, or remove submissions at our discretion.
Do not submit confidential client information, passwords, payment credentials, protected health information, or other sensitive information through comments or public participation features.
Subscriptions, contributions, sponsorships, advertisements, affiliate arrangements, reader requests, and survey responses do not provide editorial control or require favorable coverage.
JS Design Works retains editorial discretion over publication topics, schedules, conclusions, recommendations, corrections, updates, access requirements, and content removal.
To the maximum extent permitted by law, the publication, content, downloads, code examples, and reader services are provided “as is” and “as available.”
JS Design Works disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and results.
We do not warrant that the publication will always be available, that every article will remain current or error-free, that technical instructions will work in every environment, that a recommendation will produce a particular result, or that a third-party service will remain available.
To the maximum extent permitted by law, JS Design Works and its owners, employees, contractors, contributors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the publication, its content, or these terms.
This includes loss of profits, revenue, data, business opportunity, website availability, search visibility, or goodwill.
To the maximum extent permitted by law, our total liability for a claim connected to a paid publication service will not exceed the amount you paid to JS Design Works for that service during the six months preceding the event giving rise to the claim.
Nothing in these terms excludes liability that cannot legally be excluded.
We may restrict, suspend, or terminate access to publication services when reasonably necessary to enforce these terms, prevent fraud or abuse, protect readers or the publication, comply with law, address payment failure, respond to security concerns, or discontinue a service.
You may stop using the publication at any time. Provisions concerning intellectual property, payment obligations, disclaimers, liability, and disputes will continue when their nature requires them to remain effective.
We may change, replace, suspend, or discontinue publication content, subscription plans, reader benefits, pricing, access requirements, or services.
We are not required to preserve every article, feature, comment, survey, download, or subscriber resource indefinitely.
We may update these terms to reflect changes in publication services, Reader Revenue Manager, payment systems, business practices, technology, or legal requirements.
The revised terms will be posted with an updated effective date. When required, we will provide additional notice of material changes.
These terms are governed by the laws of the State of Idaho & Florida, without regard to conflict-of-law principles.
Any dispute not subject to another legally required process will be brought in a court of competent jurisdiction located in Ada County, ID & Lake County, FL. Nothing in this section limits a consumer right that cannot legally be waived.
If any provision of these terms is found unenforceable, the remaining provisions will remain effective. The unenforceable provision will be interpreted as closely as legally possible to its original purpose.
